2. General
2.1 These Terms and Conditions govern the purchase and use of all Tickets issued for Matches and the subsequent admission to any Venue. All Tickets are issued by ETPL and remain the property of ETPL at all times.
2.2 By applying for, purchasing, or being allocated a Ticket, the Ticket Purchaser and any Ticket Holder agree to be bound by, and accept, these Terms and Conditions. A person may not purchase, hold, use, or attempt to use a Ticket, or enter a Venue, if they do not understand and agree to these Terms and Conditions.
2.3 These Terms and Conditions incorporate by reference the Ground Regulations of each Venue. In agreeing to these Terms and Conditions, the Ticket Purchaser and every Ticket Holder also agree to comply with the applicable Ground Regulations.
2.4 All Tickets issued, no matter how the Ticket is purchased, used, or obtained, remain subject to these Terms and Conditions at all times. The Ticket Purchaser is responsible for ensuring that any subsequent Ticket Holder is made expressly aware of, and complies fully with, these Terms and Conditions, and shall provide each Ticket Holder with ETPL's privacy notice (see Section 12).
2.5 Any Ticket obtained or used in breach of these Terms and Conditions shall be automatically void, and all rights conferred or evidenced by such Ticket shall be immediately cancelled. A Ticket Holder seeking to use such a Ticket to gain entry to a Match shall be a trespasser and may be refused admission to, or ejected from, the relevant Venue.
2.6 Each Ticket Holder must comply with all health, safety, and security rules, status checks, requirements, codes of conduct, and protocols which may be in place from time to time at a Venue, including (without limitation) any measures introduced in response to a public health emergency or government direction.
2.7 In the case of any conflict or ambiguity between these Terms and Conditions and any abbreviated terms printed on a Ticket, these Terms and Conditions shall prevail.
2.8 ETPL and/or the relevant Venue reserves the right, in its sole discretion, to refuse admission to any Ticket Holder, to remove any Ticket Holder from a Venue or any part of a Venue, or to direct a Ticket Holder to another part of the Venue, at any time. If a Ticket Holder is refused admission to, or removed from, a Venue in accordance with this Clause, no refund of any amount paid for the relevant Ticket(s) shall be given.
3. Ticket Purchase
3.1 Ticket Purchasers must be seventeen(17) years old or above. Tickets may only be purchased through the ETPL Ticket Shop or other authorised channels published by ETPL from time to time. Any Tickets purchased from an unauthorised ticketing agent will not be valid, and the Ticket Purchaser will not be permitted to enter the Venue.
3.2 In relation to online Ticket purchases, each Ticket Purchaser may purchase up to a maximum of ten (10) Tickets for each Match. Larger group bookings may be arranged by contacting ETPL directly.
3.3 The sale or issue of any Ticket is final and non-refundable except as set out in Section 5 below or as required by applicable law. Once a booking has been made, it cannot be altered. Each transaction to purchase Ticket(s), no matter how the Ticket(s) are purchased or the number of Ticket(s) purchased, shall be subject to a non-refundable booking fee, except as set out in Section 5 or as required by applicable law.
3.4 ETPL and its authorised agents reserve the right not to replace or accept any Ticket that has been lost, stolen, damaged, forged, or that is unreadable or incomplete.
3.5 Any Ticket advertised as a 'Junior' Ticket may only be used by a child aged three (3) to sixteen (16) years (inclusive) on the date of the Match to which such Ticket relates. Any Ticket advertised as an 'Infant' Ticket may only be used by a child aged two (2) years or under (inclusive) on the date of the Match, is issued at zero value, and must be obtained for each such child, subject to any contrary provision in the Ground Regulations of the relevant Venue.
3.6 The Ticket Purchaser assumes absolute responsibility for all Tickets booked in their name and will be responsible if any of those Tickets are used in contravention of these Terms and Conditions, whether or not such contravention took place with the knowledge of the Ticket Purchaser.
3.7 ETPL reserves the right to refuse the sale of Tickets to, and to refuse admission to or remove from any Venue, any individual it reasonably believes intends to re-sell the Tickets. ETPL also reserves the right to refuse the sale of Tickets to, and to refuse admission to or remove from any Venue, anyone who: (a) is subject to a current banning order or prohibition issued by ETPL, a Venue, a sports governing body, or a competent authority in any jurisdiction, whether relating to these Terms and Conditions, ETPL rules or regulations, the International Cricket Council's rules or regulations, the Ground Regulations of any Venue, any other applicable laws or regulations, or otherwise; or (b) is, in ETPL's or the relevant Venue's reasonable opinion, a security risk.
3.8 ETPL shall be entitled to cancel any Ticket, without any liability to the Ticket Purchaser, which has (in ETPL's reasonable opinion) been purchased using any software, method, or technique (including the creation of multiple accounts linked to the Ticket Purchaser) designed to increase the chance of success in purchasing Tickets.
3.9 Any Ticket acquired, obtained, or used in breach of these Terms and Conditions shall be null and void. ETPL and/or the relevant Venue shall be entitled to confiscate, require the immediate return of, cancel, and/or invalidate any Ticket(s) offered for sale, transferred, acquired, or otherwise used in contravention of these Terms and Conditions, and no refund shall be given. In addition, if any Ticket Holder breaches these Terms and Conditions, they may have their ETPL account closed and be excluded from purchasing any Tickets in the future.
3.10 ETPL may from time to time offer Tickets at a concession rate to individuals who meet specified eligibility criteria (which may include, without limitation, age, student status, or membership of another specified group), as published by ETPL on the ETPL Website or at the point of sale. Holders of a concession Ticket must continue to meet the applicable eligibility criteria on the date of the Match and may be required to provide proof of eligibility on entry to the Venue. Any Ticket Holder unable to provide such proof to ETPL's or the relevant Venue's reasonable satisfaction may be refused admission to, or charged the difference between the concession rate and the full applicable rate before being admitted to, the Venue.
4. Transfers and Resale
4.1 Except as expressly set out in these Terms and Conditions, Tickets cannot be exchanged or transferred. A Ticket Purchaser may purchase Tickets for their own personal use and/or that of their guests, but may not purchase any Ticket as an agent for another person or with the intention of re-selling them above face value or for any commercial gain. Ticket Purchasers shall not (and shall procure that each of their guests shall not) sell, offer for sale, auction by any means, re-sell, or (save as expressly set out in these Terms and Conditions) transfer a Ticket without the prior written approval of ETPL.
4.2 A Ticket may be transferred following the original purchase by the Ticket Purchaser, provided that, in the case of each transfer that:
i. The guest is known to the Ticket Purchaser personally;
ii. It is for such guests' personal use only; iii. Such a guest would be entitled (under these Terms and Conditions) to purchase such a Ticket and/or attend the Match;
iv. The sale or transfer takes place in consideration of no payment or benefit in excess of the face value of that Ticket;
v. The sale or transfer does not take place during the course of any business or for the purpose of facilitating any third party's business; and
vi. The Ticket Purchaser remains responsible for the conduct of their guests and their compliance with these Terms and Conditions.
vii. Where the Ticket is for a Double Header, the Ticket is transferred in full and not split between two or more individuals for the separate Matches comprising that Double Header, in accordance with Section 6.12.
4.3 Tickets shall not, without ETPL's prior written permission, be:
i. Used for any promotion, advertising, fundraising, auction, raffle, or similar commercial or non-commercial purposes;
ii. Used as a prize (or part of a prize) in any contest, competition, promotional game, lottery, or sweepstake;
iii. Combined with and sold or transferred as part of any package of goods or services, or otherwise used to enhance the demand for any other goods or services;
iv. Combined with and sold or transferred as part of any travel, accommodation, entertainment, or hospitality package; or
v. Offered, transferred, used, or otherwise disposed of in the course of any business for the purpose of facilitating a third party's business or other commercial gain.
vi. ETPL reserves the right to require the immediate return of a Ticket at any time if it reasonably suspects that the Ticket Purchaser and/or any other Ticket Holder has breached these Terms and Conditions. Any Ticket offered for sale, sold, transferred, used, or disposed of in contravention of these Terms and Conditions may be cancelled by ETPL without notice, and any Ticket Holder seeking to use such Ticket may be refused admission to, or removed from, the relevant Venue without compensation or refund.
vii. ETPL and/or the relevant Venue may request photographic proof of identity of the Ticket Holder before allowing entry into the Venue, as well as proof of purchase as to how, from whom, and from where the Tickets have been obtained. If a Ticket Holder is unable to provide evidence to ETPL's reasonable satisfaction, ETPL and/or the relevant Venue may, in its absolute discretion, cancel the Ticket(s) immediately, and the Ticket Holder may be refused admission to, or removed from, the relevant Venue without compensation or refund.
5. Cancellations and Refunds
5.1 In the event of cancellation or curtailment of play due to adverse weather, ETPL shall effect any refund or reimbursement which may be due to a Ticket Purchaser in accordance with the following refund policy. The Ticket Purchaser will not need to contact ETPL to receive any applicable refund pursuant to this Section 5.1; ETPL will refund the applicable amount within sixty (60) days of the date of the affected Match.
5.2 Should a T20 event not go ahead, or less than a total of 5.5 overs are completed, a 100% refund of ticket price will apply. If more than a total of 5.5 overs are played, no refund will apply.
5.3 ETPL reserves the right to cancel, curtail, postpone, or make alterations to the time, date, duration, and location of any Match in the event of circumstances beyond the reasonable control of ETPL, including (without limitation) any pandemic, epidemic, or infectious disease; regulations, acts, requirements, restrictions, or guidance of Governments, Government agencies, or local authorities; acts of God; wars; riots; acts of terrorism (whether actual, threatened, or perceived); labour disputes, strikes, or industrial action; event safety and security concerns; public health concerns; or any other cause beyond the reasonable control of ETPL. The following refund scheme applies:
i. Spectators unable to be admitted: If spectators are unable to be admitted for any reason (for example, where a Match is to be played behind closed doors), ETPL will notify the original Ticket Purchaser via email and will automatically refund the amount paid for the Ticket(s) (including any booking fees) to the original payment method used by the Ticket Purchaser within sixty (60) days of ETPL's announcement that spectators are unable to be admitted.
ii. Capacity reduction: If ETPL is unable to honour all of the Tickets purchased or allocated for that Match, ETPL reserves the right to cancel all or some of the Tickets for that Match and to determine which Tickets to cancel in its absolute discretion. ETPL will notify affected Ticket Purchasers via email and will automatically refund the amount paid (including any booking fees) to the original payment method within sixty (60) days of cancellation.
iii. Date change: If the date of a Match changes, the new date will be notified to the Ticket Purchaser via email, and the Ticket Purchaser will have fourteen (14) days from the date of notification in which to request a refund if they cannot attend on the new Match date. If a Ticket Purchaser requests a refund within the 14-day period, ETPL will cancel the Ticket(s) and refund the amount paid (including any booking fees) to the original payment method within sixty (60) days of the refund request.
iv. Postponement without rearrangement: If a Match is postponed and not rearranged, ETPL will notify the original Ticket Purchaser via email and will automatically refund the amount paid (including any booking fees) to the original payment method within sixty (60) days of the postponement announcement.
5.4 Save as expressly set out in Sections 5.1 and 5.2 above, and to the maximum extent permitted by law, ETPL and the relevant Venue shall have no further liability whatsoever, including (but not limited to) any refund, direct or indirect loss or damage, loss of enjoyment, or travel or accommodation costs or expenses incurred or suffered by a Ticket Holder arising out of or in connection with the cancellation, curtailment, postponement, abandonment, interruption, relocation, and/or alteration of any Match.
5.5 The Ticket Holder is not guaranteed an uninterrupted or uninhibited view of any Match from the position provided, nor is any representation given as to the quality, content, or duration of any Match. The Ticket Holder acknowledges and accepts that ETPL and the relevant Venue do not guarantee any protection from the weather.
5.6 Where a Ticket has been sold at a discounted price (including, without limitation, any early-bird, promotional, group, or concession discount), any refund due under this Section 5 shall be calculated by reference to the discounted price actually paid for that Ticket (less any applicable non-refundable booking fee), and not by reference to the standard or full face value of that Ticket.
5.7 Where a single Ticket entitles the Ticket Holder to attend more than one Match on a given day (including, without limitation, a Ticket for a Double Header), a refund shall only be payable under Section 5.2 if every Match covered by that Ticket is curtailed such that fewer than 5.5 overs are completed. Where 5.5 or more overs are completed in any one Match covered by that Ticket, no refund shall apply in respect of that Ticket.
5.8 Where a Ticket Purchaser holds a Venue Pass or a Weekend Pass entitling the Ticket Holder to attend multiple Matches across multiple days, and any individual Match covered by that pass does not go ahead, or is curtailed such that fewer than a total of 5.5 overs are completed, the Ticket Purchaser shall be entitled to a partial refund in respect of each such affected Match. The refund payable for each affected Match shall be calculated as the effective per-Match price of the pass, being the total price paid for the pass divided by the total number of Matches originally covered by that pass, and shall not affect the Ticket Holder's right to attend any other Match covered by the same pass.
5.9 Where a Ticket has been purchased through ETPL's third-party ticketing services provider, any refund due under this Section 5 will be processed by that ticketing services provider in accordance with its standard refund processing timelines, which may vary from the timelines otherwise specified in this Section 5.
6. Entry Requirements
6.1 Admission to a Venue will only be authorised on presentation of a valid Ticket, in whole form and not defaced in any way. One Ticket will be required for each person entering the Venue, including Infants, in accordance with Section 3.5.
6.2 Gates at each Venue will open ninety (90) minutes prior to the scheduled start of the first Match on each Match day. ETPL and the relevant Venue reserve the right to adjust gate opening times where necessary, and any such change will be communicated in advance where reasonably practicable.
6.3 Ticket Holders under the age of seventeen (17) must be accompanied by an Adult who shall be responsible for them and for their compliance with these Terms and Conditions.
6.4 In the event of a mobile ticket being in operation for a Match, the Ticket Holder may enter the relevant Venue by showing the mobile ticket on their mobile device. In the event of an e-ticket being in operation for a Match, the Ticket Holder may enter the relevant Venue either by printing out the e-ticket on white paper or by showing the e-ticket on a mobile device. The barcode on each e-ticket and/or mobile ticket will only admit ONE entry per e-ticket and/or mobile ticket. Multiple copies must not be made; the first e-ticket scanned at the Venue will be allowed entry, however, subsequent scans (whether the original or copies) will not be allowed entry into the relevant Venue.
6.5 Pets and other animals are not permitted at any Venue. This restriction does not apply to registered service or assistance animals required for accessibility purposes, which are permitted in accordance with applicable law and the Ground Regulations of the relevant Venue. Ticket Holders requiring a service or assistance animal are encouraged to contact ETPL or the relevant Venue in advance of the Match to confirm arrangements.
6.6 Each Ticket Holder may be required at any time whilst at the Venue to produce a Ticket for inspection by or on behalf of ETPL or the relevant Venue.
6.7 Each Ticket Holder must, at all times, comply with the lawful instructions of ETPL staff, Venue management, stewards, security personnel, and any police or law enforcement officers present at a Venue.
6.8 Each Ticket Holder must truthfully answer any question put to them by a steward or member of ETPL or Venue management concerning their Ticket, including as to how, from whom, and for what consideration it was obtained.
6.9 Each Ticket Holder consents to being searched, and to having their bags and belongings searched, by security personnel or police on entry to, or at any time within, a Venue, and acknowledges that any person who refuses to be searched may be refused admission to, or removed from, the Venue without refund.
6.10 Ticket Purchasers and Ticket Holders are strongly encouraged to arrive at the Venue at least thirty (30) minutes before the scheduled start time of the Match to allow sufficient time for security checks and entry. ETPL and the relevant Venue shall not be liable for any Ticket Holder's failure to gain entry, or to gain entry before the start of the Match, as a result of arriving at the Venue shortly before or after the scheduled start time.
6.11 Save in the case of an emergency, a Ticket Holder attending a single Match is not permitted to exit the Venue and subsequently re-enter using the same Ticket. A Ticket Holder who needs to leave the Venue during a Match for any reason should inform a steward in advance to facilitate controlled and secure exit and re-entry where re-entry is permitted by the relevant Venue.
6.12 Where a Ticket entitles the Ticket Holder to attend a Double Header, the restriction in Section 6.11 shall not apply, and the Ticket Holder may exit and re-enter the Venue at any point during the Double Header, including during either Match, subject to any process specified by ETPL or the relevant Venue for monitoring re-entry. The same individual must be present for both Matches comprising a Double Header, and such a Ticket may not be used by different individuals for each Match.
7. Media and Recordings
7.1 Photographs, videos, and other audio, visual, and/or audio-visual recordings or images taken by a Ticket Holder within a Venue may be used for personal, private, non-commercial, and non-promotional purposes only. Any Ticket Holder attending a Match shall not (other than for personal, private, non-commercial, and non-promotional purposes and not for commercial gain) make or use, broadcast, narrowcast, telecast, transmit, publish, disseminate, reproduce, or circulate by any means (including, without limitation, utilising television, radio, satellite, the internet, any wireless service, or any other current or future means of format or media), any broadcast, recording, audio, video, photograph, text, data, image, statistic, result, commentary, news report, or any other information relating to any Match (in each case in whole or in part), or assist any other person(s) in the conduct of any such activities.
7.2 Each Ticket Holder attending a Match irrevocably and unconditionally and without any compensation:
i. Accepts that their voice, image, and likeness may be streamed, recorded, or captured by any means (including, without limitation, audio, visual, and audio-visual recordings by television cameras and photographers) whilst they are present at or about a Venue, and that such recordings may be transmitted and used in perpetuity by ETPL, its commercial partners, the relevant Venue, broadcast partners, sponsors, and any other licensee or assignee of ETPL by means of live or recorded video display, broadcast, transmission, or other dissemination or recording, photographs, or any other current and/or future media technologies to the fullest extent possible; and
ii. Acknowledges and accepts that ETPL is the legal and beneficial owner of the copyright and any other intellectual property rights of any nature whatsoever in and to any streaming, recordings of sound made, or images taken within a Venue (and agrees that this includes, without limitation, any streams and recordings made by the Ticket Holder in breach of Section 7.1 of these Terms and Conditions), including future rights to such streams and recordings or to any works derived from such streams and recordings, and hereby agrees, on an irrevocable, worldwide, and perpetual basis, to ETPL using, disclosing, reproducing, transmitting, exhibiting, communicating, renting, adapting, or publishing anywhere in the world any such streams and recordings in whatever form ETPL thinks fit and without making any identification of the Ticket Holder in relation thereto.
8. Betting and Integrity
8.1 In relation to any Match taking place at the relevant Venue, Ticket Holders are not permitted to use a mobile telephone, tablet, laptop, computer, or other kind of communication device to either (i) communicate or in any way transmit any form of commentary, data, or other material, for any kind of betting or corrupt or unlawful purpose; or (ii) conduct continuous betting trading activity.
8.2 Ticket Holders are reminded that cricket is subject to anti-corruption rules and codes, including those administered by the International Cricket Council. Any Ticket Holder found in breach of Section 8.1 may be ejected from the Venue without refund, have their account closed, be excluded from future Matches, and may be reported to the relevant authorities.
9. Seating and Accessibility
9.1 A Ticket entitles the Ticket Holder to admission to the relevant Venue on the Match day(s) specified on the Ticket, in accordance with the Ticket type purchased. Seating within the Venue (where applicable) is not reserved or guaranteed and is allocated on a first-come, first-served basis. A Ticket Holder agrees not to stand in a seated area or in an accessibility area during the Match.
9.2 ETPL reserves the right to adjust Venue capacity between the date of sale and the date of a Match due to temporary stand configurations or other operational requirements.
9.3 In respect of Ticket Purchasers seeking to purchase accessible Tickets, proof of eligibility may be required. ETPL publishes a separate accessibility policy on the ETPL Website covering wheelchair access, companion tickets, accessible parking, and on-Venue support. Ticket Purchasers requiring accessible Tickets are encouraged to contact ETPL in advance of the Match. Unlike general admission seating under Section 9.1, accessible seating is reserved for the Ticket Holder to whom it is allocated.
10. Prohibited Items and Conduct
10.1 The following items are not permitted at any Venue, save with ETPL's prior written consent:
i. Food and beverages brought from outside the Venue (food and beverages may be purchased at authorised outlets within the Venue, subject to the Ground Regulations of the relevant Venue); Fans are permitted to bring their own water bottles.
ii. Weapons of any kind, including replica and ceremonial weapons;
iii. Fireworks, flares, smoke canisters, and any other pyrotechnics;

vi. Drones and other unmanned aerial vehicles;
vii. Flags, banners, or signage exceeding dimensions specified by the relevant Venue, or bearing political, discriminatory, offensive, or commercial messaging;
viii. Any other item considered by ETPL or the Venue to be a security or safety risk.
10.2 Each Ticket Holder shall comply with the Ground Regulations of the relevant Venue at all times. ETPL has a zero-tolerance approach to discriminatory behaviour, abusive conduct, pitch invasion, and any conduct that endangers the safety of players, officials, staff, or other spectators. Any Ticket Holder in breach may be ejected from the Venue without refund, have their account closed, and be excluded from future Matches. Without limitation to the foregoing, ETPL will not tolerate any conduct (whether through the use of language, gestures, or otherwise) which is likely to offend, insult, humiliate, intimidate, threaten, disparage, or vilify any reasonable person - including, without limitation, any player, match official, Authorised Person, or other spectator - on the basis of their race, sex, gender, sexual orientation, age, religion, disability, culture, marital status, colour, descent, pregnancy or maternity status, nationality, or ethnic origin. Any Ticket Holder engaging in such conduct will be treated as being in serious breach of these Terms and Conditions.
10.3 Smoking (including the use of electronic cigarettes and vaping devices) is permitted only in designated areas within or outside the Venue, in accordance with the Ground Regulations of the relevant Venue and applicable local law.
10.4 In addition to the foregoing, no Ticket Holder shall, whilst at or in the vicinity of a Venue:
i. Enter or attempt to enter the playing field, any dressing room, practice area, or any other area for which accreditation or specific authorisation is required;
ii. Throw, or attempt to throw, any object that might injure or cause damage to any person or property;

Any Ticket Holder in breach of this Section 10.4 may be refused admission to, or ejected from, the Venue without refund, in accordance with Section 2.8.
10.5 Ambush Marketing and Unauthorised Commercial Activity. No Ticket Holder shall, without ETPL's prior written approval:
i. Engage in any Ambush Marketing or conduct any activity that conflicts with, infringes upon, or impairs the rights of any Commercial Partner;
ii. Offer any goods or services for sale at or in the vicinity of a Venue, including (without limitation) food, drinks, merchandise, or printed materials; or
iii. Distribute, or attempt to distribute, any flyers, leaflets, or other promotional, advertising, or commercial material, or otherwise represent themselves as an official partner, sponsor, or representative of ETPL or the League, unless expressly authorised in writing by ETPL to do so. Any Ticket Holder in breach of this Section 10.5 may be refused admission to, or ejected from, the Venue without refund, and any items used in connection with such breach may be confiscated in accordance with Section 10.7.
10.6 Where a Ticket Holder is refused admission to, or ejected from, a Venue under these Terms and Conditions, ETPL may, at its discretion, cancel any other Ticket(s) held by that Ticket Holder for any other Match, and may refuse that Ticket Holder admission to any other Venue for the remainder of the League, in each case without any obligation to provide a refund or other compensation.
10.7 Each Ticket Holder is individually responsible for their own property brought to or into a Venue, including any Prohibited Item. No storage facility is available at any Venue for such items, and any item confiscated in accordance with these Terms and Conditions may be retained or destroyed at ETPL's or the relevant Venue's discretion, without any obligation to return such item or compensate the Ticket Holder in respect thereof.
11. Liability
11.1 Each Ticket Holder admitted to a Venue acknowledges that their presence and/or movement in and around a Venue is at their own risk, and that, to the maximum extent permitted by applicable law and except as otherwise set out in these Terms and Conditions, neither ETPL, the relevant Venue, nor any of their authorised agents, employees, directors, officers, or volunteers are liable for any loss, damage, cost, expense, liability, injury, or harm howsoever caused to or suffered by a Ticket Holder arising from a Ticket Holder's attendance at a Venue in connection with any Match (including, without limitation, arising as a result of the cancellation, postponement, curtailment, abandonment, interruption, alteration, or relocation of the same in each case). Without limitation to the foregoing, each Ticket Holder acknowledges that attendance at a Match, a Venue, and any related activities (including, without limitation, any interactive or fan engagement activities conducted at a Venue) involves certain inherent risks which cannot be eliminated, and each Ticket Holder voluntarily accepts and assumes such inherent risks, including (without limitation):
i. The risk of personal injury (including death, fractures, burns, sunburn, cuts, abrasions, fainting, or other physical injury) arising from, among other things: contact with cricket balls, bats, or other equipment used in connection with a Match; contact with other spectators, players, officials, or other persons; slips, trips, or falls while moving around the Venue; and exposure to weather conditions, including sun, rain, wind, or storms;
ii. Exposure to communicable diseases, viruses, bacteria, or illnesses, which may occur wherever people gather in public; and
iii. Loss of, theft of, or damage to personal property occurring before, during, or after a Match.
11.2 Each Ticket Holder shall be responsible for any loss, damage, or injury caused by that Ticket Holder through their negligent, reckless, or wilful acts or omissions, and shall indemnify the Released Parties against any third-party claims, losses, liabilities, damages, costs, and expenses arising directly from such conduct.
11.3 Each Ticket Holder shall be responsible for (and shall make good) any loss, injury, or damage suffered or incurred by ETPL and/or the relevant Venue (including any of their respective employees, directors, officers, or volunteers) as a direct consequence of a breach by the Ticket Holder of any of these Terms and Conditions.
11.4 Nothing in these Terms and Conditions seeks to exclude or limit ETPL's liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other type of liability which cannot be excluded or limited by law. ETPL's total liability in all other circumstances shall otherwise be limited to the face value of the affected Ticket Holder's Ticket(s).
12. Data and Privacy
12.1 ETPL shall use all personal data provided by a Ticket Purchaser (including information provided about Ticket Holders pursuant to these Terms and Conditions) in accordance with applicable data protection law, the consents given by Ticket Purchasers, and ETPL's privacy notice available at etplofficial.com/privacy, which is made available at the point of purchase and is incorporated into these Terms and Conditions by reference.
12.2 ETPL acts as data controller in respect of personal data of Ticket Purchasers and Ticket Holders. Personal data may be processed on ETPL's behalf by ETPL's ticketing services provider acting as data processor, subject to a written data processing agreement which incorporates appropriate safeguards for the international transfer of personal data outside the European Economic Area where applicable.
12.3 The Ticket Purchaser shall provide ETPL's privacy notice to any subsequent Ticket Holder to whom the Ticket Purchaser transfers a Ticket in accordance with Section 4.
13. Intellectual Property
13.1 A Ticket Holder's purchase and/or possession of a Ticket for a Match does not confer any rights (by implication or otherwise) on them to use, alter, copy, or otherwise deal with any of the symbols, trademarks, logos, and/or intellectual property appearing on the Ticket or otherwise belonging to ETPL, its franchise teams, sponsors, or commercial partners.
14. Miscellaneous
14.1 Each of the paragraphs of these Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
14.2 These Terms and Conditions (and all documents incorporated into these Terms and Conditions by reference) constitute the entire agreement between the parties, and no party shall have any claim or remedy in respect of any statement, representation, warranty, or undertaking made by or on behalf of any other party in relation to these Terms and Conditions which is not already set out in these Terms and Conditions.
14.3 These Terms and Conditions shall not affect a person's statutory rights as a consumer.
14.4 Save for the rights of the relevant Venue as expressly stated in these Terms and Conditions, any person not a party to these Terms and Conditions shall have no rights of enforcement in respect of any term of these Terms and Conditions.
14.5 These Terms and Conditions shall be governed by the law of Ireland, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms and Conditions, their subject matter, or formation, shall be subject to the exclusive jurisdiction of the courts of Ireland. Notwithstanding the foregoing, ETPL reserves the right to pursue legal proceedings in a competent court of the Ticket Holder's domicile, where such proceedings shall be governed and interpreted in accordance with Irish law. Nothing in this Section affects any non-waivable rights a consumer Ticket Holder may have under the law of their habitual residence within the European Union.
14.6 ETPL reserves the right to make amendments to these Terms and Conditions from time to time in its sole discretion. A full copy of the latest version of these Terms and Conditions (as amended, if applicable) will be available on the ETPL Website and, upon request, from ETPL.
14.7 These Terms and Conditions have been drafted in the English language. In the case of any conflict or ambiguity between the English version of these Terms and Conditions and any translation of them into any other language, the English version shall prevail.
14.8 In addition to the rights of the relevant Venue under Section 14.4 above, ETPL's ticketing services provider shall have the right to enforce those provisions of these Terms and Conditions which relate to data protection (Section 12), intellectual property (Section 13), and the indemnities given by Ticket Holders (Section 11).
